These terms of service ("Terms") govern your use of the App, which is operated by Vivien Annett Hoffmann("we", "us", "our"), Lindenstr. 17, 01623 Lommatzsch, registered in Germany. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App. We reserve the right to update these terms of service at any time. We will notify you of any material changes by posting the new terms on the App and updating the "Last Updated" date at the top of this document. Your continued use of MissingBridge after the posting of the revised terms means that you accept and agree to the changes. 2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. 2.3 Account Security We are not liable for any loss or damage arising from your failure to comply with the above requirements. You may be held liable for losses incurred by us or any other user of the App due to someone else using your account as a result of your failure to keep your account information secure and confidential. 3. User Responsibilities 3.1 Prohibited Activities You agree not to use the App for any illegal activities, including but not limited to: Engaging in any activity that violates any law, statute, ordinance, or regulation. Committing fraud or engaging in deceptive practices. Uploading or transmitting any viruses, malware, or any other harmful code. Harassing, abusing, or threatening other users. Infringing upon the intellectual property rights of others. 3.2 Data Accuracy You are responsible for ensuring the accuracy of all order information and product details synchronized between Spreadconnect and Bandcamp through the App. The App facilitates the synchronization of data between platforms but does not verify the accuracy of the information provided. 4. Subscription and Payments 4.1 Pricing Model The App operates on a monthly subscription basis. Access to the synchronization features requires an active subscription. Current pricing information is available on our website. 4.2 Payment Methods Our order process is conducted by Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 4.3 Refund Policy Refund policies are handled separately from these Terms. Please refer to our refund policy documentation for detailed information on how refunds are processed. 5. Privacy and Data Protection 5.1 Data Collection We collect and store: - Your email address for account management and communications - Bandcamp order IDs and dates for synchronization purposes - Spreadconnect product IDs and titles for integration functionality 5.2 Data Usage We use the collected data solely to provide the synchronization service between Spreadconnect and Bandcamp platforms and to communicate with you regarding your account and service updates. 5.3 Data Sharing We do not share your personal data with third parties, except as required by law or to protect our rights. Integration data is only shared between the connected platforms (Spreadconnect and Bandcamp) as necessary for the service to function. 6. App Usage 6.1 Availability We strive to keep the App available at all times, but we cannot guarantee uninterrupted access to the App. There may be times when the App is unavailable due to maintenance, upgrades, or other reasons beyond our control. 6.2 Modifications We reserve the right to modify, suspend, or discontinue the App or any of its features at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App. 6.3 Third-Party Services The App integrates with Spreadconnect and Bandcamp services. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability or functionality of these third-party services. 7. Governing Law and Dispute Resolution 7.1 Governing Law These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. 7.2 Dispute Resolution Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the rules of the German Institution of Arbitration (DIS). The place of arbitration shall be Germany, and the language of arbitration shall be English. 8. Limitation of Liability 8.1 General Limitation To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: Your use or inability to use the App. Any unauthorized access to or use of our servers and/or any personal information stored therein. Any interruption or cessation of transmission to or from the App. Any errors or inaccuracies in the synchronization process between platforms. 8.2 Cap on Liability In no event shall our aggregate liability for all claims relating to the App exceed the amount paid by you to us, if any, in the past six months for the use of the App. 9. Termination 9.1 Termination by User You may terminate your account at any time by following the instructions in your account settings or by contacting us at [Your Contact Email]. 9.2 Termination by Us We reserve the right to terminate or suspend your account at our discretion, without prior notice, if you violate these Terms or if we believe termination is necessary to protect our interests or the interests of other users. 9.3 Effect of Termination Upon termination of your account: - Your subscription will be cancelled - Access to the synchronization features will be immediately revoked - Stored order and product data will be deleted from our systems We are not responsible for any loss of data resulting from the termination of your account. 10. Changes to Terms 10.1 Amendments We may amend these Terms at any time by posting the amended terms on the App. Your continued use of the App after the effective date of the amended terms constitutes your acceptance of the amended terms. 11.
